The Louisiana Supreme Court has asked a Baton Rouge district judge to review his decision to throw out Gov. Bobby Jindal's revamp of teacher tenure and salary laws – called Act 1.
Judge Michael Caldwell had ruled that the legislation was unconstitutional because it bundled together too many items spanning Louisiana's education laws.
The court sent the case back, saying a recent ruling on Act 2, which created the state’s voucher program, will better inform Caldwell on how to decide the case. The Court said it would be exerting too much control over the legislature to make a ruling based on the number of items.
State Superintendent John White was optimistic about the new decision Friday.
“The Supreme Court’s ruling on the Act 2 case was very clear on to what constitutes a duel object and as a result this court’s new consideration of this will be based on a much more favorable interpretation of the law than perhaps had been the case before," White said.
What happens next is in the hands of the district court.
